Can my mortgage or home equity bank repossess my car if I stopped making mortgage payments?

I am ready for foreclosure. I cannot afford any more payments. I have two cars that are fully paid and I am just wondering if a bank can repossess or put a lien on them?

Nope. They only have the right to your home.

Bankruptcy - would give them the right but not foreclosure.

Why should I pay my mortgage if I can get the tax payers to bail me out?

Obama plans on stopping foreclosures! Why not let the government pay for my house? Or give me such a low interest rate that I can pay it off and resale it for a bigger profit? Or just sale it and move to a better nieghborhood?
It is sad that you just support Obama and you don't hear what he says!
He is now pushing to stop all forclosures! It's called a moratorium on all forclosures!!!

And what is even more sickening is that the mortgages that are being called in and foreclosed are being represented as their total end value.
That means when a $200K house is foreclosed on, the end value of $600K is what is being called in.
We are all screwed, as we knew at the beginning of this debacle.

we really don’t want to lose our home and at first had this defeated attitude now we are realizing we have more options than we thought. is it too late to act on them? the foreclosure process started in april or may and we live in ohio if that helps. we went to court about a month and a half ago or so with the option of reinstating our loan but we haven’t turned the proper paper work in yet. what would be some good steps to take from this point to save our home? thanks.

It’s only too late when your redemption period expires.

However, the closer that deadline is, the less likely you are to get good results.

You’re in a fairly long timeline state, so that is good.

However, getting these situations reversed is a LOT trickier than if you’d been able to do something before the court date.

Based on what borrowers are telling me, most homeowners who call during this time frame are being told that they need to pay off the loan in order to keep the home.

Depending on the type of loan you have, this may or may not be true.

The fact is, most servicers are doing everything they can to AVOID doing a lot of work… and files with your circumstances require much more work than a loan that’s 30-60 days late.

There are two keys here:

1- Putting together a package that looks GREAT. [Just "turning in the paperwork" is not enough to get the best results. See the case study below to see what I mean.]

And…

2- Getting that package in front of the right person

If you send it through the normal channels, it’s likely to get ignored because of all the factors at play here.

West Georgia National Bank own my loan, how can I stop foreclosure ?

My loan is no own by Freddie Mac or Fannie Mae, and I got served yesterday , what can i do to buy some time until the end of the month and be able to move all my stuff before they lock it. thank you

tell them to "produce the note". They CANNOT foreclose on you if they cannot prove they actually own the mortgage.

It is possible that if your loan got sold the loan paperwork is messed up. It is even possible that the bank who says it owns the note, actually doesn't.

Find a lawyer, if you can afford it, and ask about it.

There is some fraud going on in all of these foreclosures, so you might want to look into this anyways.

Barring that, simply ask for some time to get everything out.

Remember once they change the locks, your stuff is THEIR stuff, as they can legally sell it to recoup some of the money you borrowed.

they already wanted to start the process and they sent a guy out to check out the house and see what condition it was in. what are some things i can do, i got behind when my husband walked out on me. i want to save my house but i need some options also im only a co-signer on the mortgage. any help would be great. thank you.
but they already sent someone out to look at my house, that was when i thought there was nothing i could do about it. the mortgage company doesnt do interest-only but ive had the house for 2 1/2 years with no late payments or anything other then recently… im really stressed and my husband said he doesnt care, he has a home to live in….i just want to make sure i can still stop it
they are saying that i am officially 3 months behind, because i sent in the mortgage payment and they gave me my cash back and then i sent in 2 of the 3 months and they sent them back. i am just really stressing because this is my home and its all i have and i dont want to lose it.

This is serious, and many people are going thru the same exact thing.

You NEED to get in contact with local services that can help you. These are non profit services provided by the county, city, or state, and they are there to help YOU. the only problem is, they dont advertise, so you have to do the foot work to locate these services.

Try google and search that way, or start by calling your local health and human service people in your area, they deal with health and welfare, you know, wic, food stamps etc., but they know of the local organizations that can help with housing and what not.

Once you are in the process, you can get out. its when you are on the auction block, thats when you know its too late… dont let it get that far.

PLEASE find help!

DO NOT… sign a deed over to anyone, or pay anyone, other then your mortgage company, or the collection/attorney working for your mortgage company. There are MANY scams out there that say they will help you, but take you for all your worth, incuding the house.

There is too much help out there to let it get to the auction block. I hope you can find it.
