I would prepare the bankruptcy petition. It is the attorney’s job to make sure the petition is proper. By the way, what makes you think it is unwarranted? The mere fact that the petition is designed to stop foreclosure proceedings does not necessarily make it unwarranted.

How can I find if a law group business is legit?

I need help to stop foreclosure on my house and to refinance. I went to a law group that advertises on the radio. They say my case can be worked. The are asking for a fee. Is this normal? I want to know if anybody has had any troubles with this company. I’d hate to pay the fee and have nothing come out of it.
I already checked with the BBB. They haven’t applied.

Sounds like a scam to me.

Yes you certainly can, but if you wait until the sale date is set, you might have to file chapter 13 bankruptcy to stop it. You will get a lot of answers here from sarcastic people saying "pay up your account". But I realize that you wouldn’t be here asking this if you currently had the ability to get current on your mortgage payments. I feel bad for you and everyone else in your situation.

yes i did ruin my credit badly i bought the house when i was 25 with over 700 credit score i was load off my job shortly after and struggled, had past dues 30s and 60s, i was barely making it.i decided to move out of state and decided to keep the house, my new salary was barely covering my rent and my mortgage along with the new expenses, so i decided to rent it out, bad idea, bad renters, destroyed it, never paid. i fell behind more and more. believe it or not, there has been a breakthrough in my career with my potentional salary be doubled, the only problem is it wont take in effect till the following few months unfortuantely for me i couldnt stop the foreclosure sale on my house and the mortgage company would not stop or postpone the sale even after providing most of the past dues.the sale went thru this morning. i am devastated yet relieved their redemption perion is for the full payoff amount.now my credit is at rock bottom.no creditcard debt tho, how long will my credit be shot?

forgot to mention, for those wondering, yes i did list it for 9 months with 2 or 3 offers both in which i have to bring like 20,000 to closing, i do not have a second mortgage when i bought it it was from a bank, so it was already reduced, and had a 5.5% interest fixed for 30 years. home values went down in that area… and if ur wondering what state, you guessed it.. michigan.
first i need to be secured in the new job position.. but say in 12-18 months i want to buy a 300-400k house and DID have the 20% down seasoned, even tho with a recent foreclosure, i may still get qualified for a loan at say a decent rate…?
sorry to bother you all again…alright i just spoke to the mortgage company and the lawyers, the house did NOT sell to a third party,how would that affect me? and the mortgage company would NOT give me another chance at it to reinstate the loan. they told me i have a 6 moth redemption…do u think its worth it?

I have to admit, I didn’t read your whole story, but if you work hard to repair your credit, in 3 years time, you may be able to purchase another home. Please don’t beat yourself up over this. We are told it will stop a bank foreclosure and all suits dead in their tracks, but how bad are the credit repercussions?

If you are facing foreclosure and you are having collection calls, your credit have taking a hit. Now yes chapter 13 will stop all your creditors from contacting you and you will save your home and other assets.

I did Chapter 13 and it was a living hell because you have to live with cash and how much is left for you it is dictated by the Trustee. All your unsecured you have to pay a percentage between 5-10%, however if you owe on a student loan, back taxes, child support you have to pay 100%.

You can put every single creditor in your chapter 13 including your mortgage payment and just make a payment every month (that is what I did) and deffer your student loan.

Your husband should look for a part-time after you go to the Court, because money is going to be very, very tithe, I’m saying after he goes to court because if he has a second job his income from this job will be taking in consideration for your monthly payment.

what steps are necessary to stop a foreclosure as you attempt to sell the property, and how long does the foreclosure process take?

Foreclosures can begin the first day you are in default, but generally don’t begin until about the fourth month late. You can stop them by paying the mortgage up to date, or by negotiating a payback plan, considering that you have some equity in the house. The lender doesn’t really want to foreclose, but they will if you can’t agree on a payment plan that is acceptable to them. Another way is to file chapter 13, which will buy you some time as you are trying to sell the house. Once it is sold you simply dismiss the chapter 13. I have know of foreclosures that took two years and others that were complete in five to six months. Once you miss four payments the credit bureaus report 120 days late your credit is ruined as 120 days is considered to be a foreclosure, even if you save the house. It will take at least two years to get your credit back to where you can purchase another house with a mortgage, and in some situations three and more years. Be sure to pay all your other bills during this process as you can explain the reasons that caused the problem and it will work to your advantage later on. Foreclosure laws vary from state to state, and the non judicial foreclosure states are the fastest to obtain the foreclosure. Check your state laws and cover yourself accordingly.

Boyfriend lied, and said I used his Visa without authorization?

Boyfriend owed me money. He said I could pay a month of homeowner dues for a timeshare I own. It had just gone to a "collection dept" . I paid it with his card, I had his mailing address, and the CVV code. I received on confirmation code from the collection department. A week later, he hit me, I called the police. I dumped him. A few days later he called VISA and said I used his card without his permission. I found out about this about 6 weeks later when the collection agency sent me a letter stating I owed them $480.00 now, and they had received a chargeback from VISA. I mailed them a letter stating the charge was authorized and VISA should not have reversed. I asked them to persue it. Now, 4 months later I received a notice from the TimeShare that they are gonig to foreclose for lack of payment. Well, we only owe 1 quarter dues. The one that was reversed. Anyway - they want me to now pay $872.00 in order to stop foreclosure. What rights do I have. How can he lie and file a false report that I used his card w/o his permission. I had his permission, the card, the CVV#, his mailing address - everything. Shouldn’t the collection agency advised me of their intention? Don’t they have to contest the chargeback. What should I do? very frustrated!

You expect integrity out of a man that treats others like he treated you? He obviously only cares about himself and not about you.

He is the account owner, it’s his word against yours and, if you are not an official authorized user, then he can challenge any charge that does not have his signature.

Basically, you need to pay the association what they are due and cut your losses. Consider yourself lucky it only cost you $872 as opposed to him putting you in the hospital - or worse.

Ok,this is a long confusing tale.My parents have both been gone for over 6 years,and my brother handled their estate.He passed away recently and I found out he never completed handling things.He never closed the probate.The house is now about to go into foreclosure.And I now have to do a probate on him and close the probate on my parents.The problem lies in the fact that I live in a mobile home that is in his name,but on my parents property.How do I stop foreclosure if I don’t have the finances to pay the house off?If I can’t,can I move the trailer off the property?If it does go into foreclosure,how long do I have after that before I have to move?Please help!!!

Since your brother has died, and you were unaware of the financial state of affairs, you may be given some time to get things straightened out, so everything isn’t taken or lost..

Don’t wait until the last minute. Find someone within the next couple days.

I need to write a letter for my lawyer, explaining how much money my fiancee’ brings in each month. It’s to stop foreclosure on our property. Since i currently cannot find a job in flint, he needs this for the court, and to file it tomorrow. I have a general idea on how to word it, but a little input would be helpful. Thank you.
